Terms of Sales

Unless agreed in a written note by MTA, this terms and conditions govern the existing business relationship between MTA and its customers. The version of the general terms and conditions of sale is the one published on this website at the date of the firm booking of the customer.

1. Booking conditions

1.a. Firm Reservations

A reservation is deemed to be a firm reservation after a written confirmation from MTA. A reservation or order will be considered as firm after receipt by MTA of a deposit of 30% of the total amount of the order from the customer. If the booking is made within thirty days of the scheduled date of the flight, this deposit must be equivalent to the total amount of the order. Any booking or flight order must have been paid in full before boarding. Any firm reservation is definitive and remains subject to availability on order.

1.b. Exchange rate

For a payment in currencies other than Euro, the exchange rate used will be the official weighted average rate on the date of departure of the customer. In the event that the service is prepaid, the official rate at the time of invoicing will be withheld.

1.c. Payment of the reservation deposit

A firm reservation may be considered null and void and consequently canceled without prior notice if the payment of the required deposit has not been received by MTA within the deadline. The payment of this deposit can be made by bank transfer to the account of MTA: MADAGASCAR TRANS AIR whose coordinates are the following:

The name of the originator and the name of the reservation must be identical. The transfer costs shall be borne by the originator.

2. Cancellation penalties

2.a. For meteorological reasons

After order, the flight is scheduled at a date and a time, unless in the event of adverse weather; MTA will be able to honor the order under normal conditions by making one or more delays.

2.b. For other reasons

If the customer cancels a firm booking within thirty days of the date of the flight for any reason beyond the control of MTA, the latter will retain a percentage of the total amount of the reservation in payment of cancellation penalties.

– From thirty days to 14 days before the scheduled flight date, this penalty will be 10% (ten percent)

– From fifteen days to seven days, it will be 30% (thirty per cent)

– From six days to 48 hours, it will be 50% (fifty per cent)

– For less than 48 hours, it will be 100% (one hundred percent).

The costs of transferring a refund will be borne by the customer.

3. Prices

MTA reserves the right to modify its rates during the period to take account of changes in transport costs, usually related to the cost of fuel, changes in fees and charges for services provided and changes in the exchange rate applied to the flight. The prices and information other than the present “general conditions of sale” and “the conditions of use of the site” published on the website www.mta.mg are indicative and cannot engage the responsibility of the company MTA.

Supplementary or replacement services incurring additional costs must be paid on site.

4. Responsibilities

4.a. Exceptional Events

MTA cannot be held liable for the consequences of the following events:
• Incidents or unforeseeable and insurmountable events of a foreign third party such as: wars, political unrest, riots, strikes, technical incidents beyond the control of MTA, bankruptcy of a service provider, adverse weather, delays, breakdowns, loss or theft of luggage or other effects. The delay or delays caused by the above mentioned cases, as well as the modifications of itineraries that may result therefrom, shall not entail any compensation from MTA for any reason whatsoever. In the cases referred to above, the liability of the customer remains and may be incurred as compensation for the damage suffered by MTA if the customer is the direct or indirect cause of the incidents or events.

• Cancellation or modification imposed by circumstances of force majeure and /or for reasons related to the safety of the customer and /or an injunction of an administrative authority.

4.b. Legal Limitations

Limitations of liability apply to the MTA in accordance with Decree No. 2008-196 on the liability of air carriers and operators of aircraft registered in Madagascar engaged in domestic air transport. In article 4 of this decree: “Responsibility to passengers”: paragraph 1 states that “The liability of air carriers and aircraft operators for damage suffered in the event of death or injury, by a passenger in the event of an accident is limited to two hundred and two million five hundred thousand Ariary “. Paragraph 2 stipulates that “However, by a special agreement with the air carrier or the aircraft operator, the passenger may set a higher liability limit”. Article 6: “From liability in case of delay”, stipulates that “In the event of damage suffered by passengers resulting from a delay, the limit of liability of the air carrier or the aircraft operator is six million seven hundred and twenty thousand Ariary per passenger “. Article 11 – “Delay”, however, states that “The air carrier shall be liable for damage resulting from delay in the carriage of passengers, baggage or cargo by air. However, the carrier shall not be liable for damage caused by delay if he proves that he, his servants and agents have taken all measures that might reasonably be required to prevent the damage, or that they could not take them.”.

4.c. Website Information

Although the information contained on this MTA website (www.mta.mg) is as accurate as possible, it may contain errors. The information of order other than the present general conditions of sale and the conditions of use of the site www.mta.mg cannot bind MTA nor incur its responsibility. The contents of the website are provided “as is”, without warranty either expressed or implied, including (but not limited to) any implied warranty of merchantability, technical, pricing, or fitness for a particular purpose.

5. Complaints

Except in case of force majeure and without prejudice to a possible appeal, complaints must be addressed to the address below by registered letter with acknowledgment of receipt no later than 20 days after the date of the flight of the customer. MTA, BP 4070, Antananarivo, Madagascar

6. Jurisdiction

This Agreement and its execution are governed by the laws of Madagascar, regardless of conflict of laws. The user agrees to respect the jurisdiction of the Courts of Madagascar, for any question or dispute arising from the use of this site and this agreement.
